Any changes to these Terms will be effective as of the "Last Updated Date" shown below. Continued use of the Platform after that date constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 18 years old and reside in the United States to use the Platform. By using it, you represent that you meet these requirements.
Account Registration
You must create an account through Beehiiv to access subscription features. You agree to provide accurate information during registration and to keep your login credentials secure. You are responsible for all activities under your account.
Communications From Us
By creating an account or subscribing to our free or paid newsletter, you consent to receive communications from AllerGuard, including account updates, service announcements, newsletters, and promotional messages. You may opt out of marketing communications at any time by following the unsubscribe link included in those messages. Transactional or service-related emails may still be sent as necessary to provide our services.
Subscriptions and Payments
Subscriptions are managed through Beehiiv and processed via Stripe. One-time search credit purchases are also processed via Stripe. AllerGuard LLC does not store your payment information. All payments are subject to Stripe’s terms of service.
Refund Policy
All purchases are non-refundable unless required by law. If you experience technical issues or cannot access paid features after payment, please contact us and we will make reasonable efforts to assist you.
Intellectual Property
All content, trademarks, and technology on the Platform are the property of AllerGuard LLC or its licensors. You may not reproduce, modify, distribute, or reverse-engineer any part of the Platform.
DMCA Notice
If you believe any content on the Platform infringes your copyright, submit a DMCA takedown request to contact@allerguardrx.com. We will review and respond in accordance with the Digital Millennium Copyright Act.
User Content
You are responsible for content you post in any community or forum areas. You grant AllerGuard LLC a non-exclusive, royalty-free license to use, display, and moderate your contributions. Offensive or inappropriate content may be removed at our discretion.
Prohibited Conduct
Users agree not to misuse the Platform or its content. Any such behavior may result in immediate termination of access without notice. Prohibited conduct includes, but is not limited to:

Medication data is sourced from the U.S. National Library of Medicine’s DailyMed database. While we strive for accuracy and timeliness, updates may lag behind DailyMed’s official site.

Care has been taken in the preparation of the information contained on the Platform. However, we do not make any representations or warranties as to the accuracy of the information contained on this Platform.

Mediation
YOU ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN MEDIATION. ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) ARISING FROM OR RELATING IN ANY WAY TO YOUR USE OF THIS APP WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY MEDIATION. IN ADDITION, YOU ALSO WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR CLASS-WIDE PROCEEDING.
No Waivers
The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of the Company.
No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you.

All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the State of Georgia without giving effect to any choice or conflict of law provision or rule (whether of the State of Georgia or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Georgia.

By submitting feedback, suggestions, or ideas (including ingredient corrections or feature requests), you grant AllerGuard LLC a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, modify, and incorporate such feedback without compensation or restriction.
Severability
If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
Entire Agreement
Our order confirmation, these Terms, our Website Terms of Use and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
